Rule 18
Appointment of conciliator by parties
(1) After the order to settle the case filed before the body hearing the case through conciliation, the parties to the case shall appoint a maximum of three conciliators from among the following persons:-
(a) A conciliator registered with the concerned adjudicating body,
(b) A person who has received a certificate to work as a conciliator in accordance with section 21 of the Act.
(2) Notwithstanding anything written in sub-rule (1), if the parties propose a person to be a conciliator, a person who has not received conciliator training and certificate can also be appointed as a conciliator.
(3) Notwithstanding anything written in clause (a) of sub-rule (1), in the case of cases filed in the Supreme Court and High Court, the parties may, if they wish, appoint a person on the list of conciliators prepared by the respective district court as a conciliator.
(4) According to sub-rule (1), if the parties choose a conciliation-related organization to work as a facilitator of the conciliator, if such organization has provided for separate regulations or procedures regarding the appointment of the conciliator, the parties shall appoint the conciliator in accordance with such regulations or procedures.
(5) Notwithstanding anything written in sub-rule (1), if the parties request the name of a conciliator from such organization to act as a facilitator of the conciliator, the said organization may recommend and send the name of a conciliator from among the conciliators listed in its organization.
(6) In accordance with sub-rule (5), after recommending and sending the name of the conciliator, the organization working on reconciliation shall recommend and send the name of a suitable person in accordance with sub-section (3) of section 6 of the Act.
(7) If the parties agree to appoint one conciliator, with the consent of both parties and if three conciliators are to be appointed, each party shall appoint one conciliator and the parties themselves or two conciliators so appointed shall appoint a third conciliator.
(8) If three conciliators are appointed, the third conciliator will act as coordinator.
