(1) In the following cases, the posts of chairman, member and executive director shall be deemed to be vacant (a) If the chairman or executive director resigns in writing to the Government of Nepal and the member resigns in writing to the chairman,
(b) Absent from three consecutive meetings of the Board without informing the Board,
(c) If convicted by a court of an offense referred to in clause (c) of section 18,
(d) If his term of office expires,
(e) If he is removed from office as per sub-section (2),
(f) In case of his death.
(2) Notwithstanding anything written in sub-section (3) of section 13 and sub-section (2) of section 20, if the chairman, member or executive director does any act contrary to the interest of the board or does not fulfill his official duties, in the case of the chairman and executive director, the Government of Nepal and the nominee In the case of a member, the ministry may remove him from office at any time before the end of his term of office.
(3) According to sub-section (2), before removing the chairman, member and executive director from their positions, they should be given a reasonable opportunity to present their vindication on the charges against them.
(4) If the chairman, member or executive director who has been accused according to sub-section (3) destroys the evidence against him or causes any harm to the board while he is still in office, the appointing or nominating officer may immediately suspend him from office.
(5) The period of suspension under subsection (4) shall not exceed three months.
