Rule 5
Method of Recruitment

(1) The following vacant posts in the general service of the Nepali Army will be filled as follows:- img
(1a) In accordance with Clause (d) of sub-rule (1) for promotion to the post of Assistant Soldier post reserved for promotion and for the post reserved for filling by internal competition, if no qualified candidate is available for internal competition or if the post cannot be filled by promotion or by internal competition for any other reason, such post shall be open in the advertisement for filling up the post immediately thereafter. The posts will be filled by including the posts filled by the competition.
(2) According to sub-rule (1), forty-five percent of the number of posts to be filled by open competition shall be set aside for inclusion, and the number shall be considered to be 100%, and the posts shall be filled by separate competition only among the following candidates:-
(a) Women – twenty percent
(B) Tribal/Tribal - Thirty-two percent
(c) Madheshi – twenty-eight percent
(d) Dalits – fifteen percent
(e) Backward Areas – Five percent Explanation:
(1) For the purposes of clauses (b), (c), and (d) of this bye-law, "women, tribals/tribals, Madhesi, Dalits" means economically and socially backward women, tribals/tribals, Madhesi, Dalits. .
(2) For the purpose of clause (e) of this sub-rule, "backward area" means the districts of Manang, Mustang, Acham, Kalikot, Jajarkot, Jumla, Dolpa, Bajhang, Bajura, Mugu and Humla.
(2a) Notwithstanding anything else written in this rule, five percent of the vacant posts to be filled through open competition shall be filled by competition from among the descendants of soldiers who have been physically disabled as a result of any physical injury while performing their duties during military training and who have died in the line of duty. In this way, the advertisement for the year that has been allotted for filling the postIf a candidate is not available in the advertisement of that year, or if the post is filled, the number of unfilled posts will be included in the advertisement of the same year to be filled by open competition.
(3) A candidate under clause (b), (c) or (d) of sub-rule (2) can contest only as a candidate of a community of one section. But this arrangement will not apply to women.
(4) For the purpose of filling the post according to sub-rule (2), the details of women, tribal/tribes, Madhesi and Dalit communities who are economically and socially backward will be as specified by the Government of Nepal by publishing a notice in the Nepal Gazette. But until such time, any women, tribal/tribal, Madhesi and Dalit communities will be considered as economically and socially backward communities.
(5) When submitting an application for a post allotted as per sub-rule (2), the following evidence shall be attached:-
(a) For tribals/tribes who have been certified as tribals/tribes by the Nepal Tribal/Tribal Upliftment National Foundation, but have more than one surname within the caste listed in the Nepal Tribal/Tribal Upliftment National Foundation Act, listed by the Chief District Officer on the recommendation of the concerned local level head Surname must be verified and submitted along with the application.
(b) For Dalits, who have been certified as Dalits by the National Dalit Commission, but have more than one surname within the caste listed by the National Dalit Commission, on the recommendation of the head of the local level concerned, the application must be certified by the chief district officer as a surname within the listed caste.
(c) For Madheshis, the government of Nepal has published a notice in the Nepal Gazette and certified them as Madhesi from the institution as specified, but until the institution has been published in the Nepal Gazette and the institution has been designated, the application must be certified as "Madhesi" by the chief district officer on the recommendation of the head of the local level.
(d) Permanent residence in the districts mentioned in sub-rule (2) for backward areasIt is recommended that the certificate of citizenship has been obtained from Ndhit district and permanent residence in the same place till the time of application from the concerned village development committee or municipality.
(6) In determining the percentage according to sub-rule (2), if there is an exponent (fraction) of less than one percent, such exponent will be transferred to the next community immediately after that. (7) According to sub-rule (2), if candidates are not available in the advertisement for the year for which the advertisement is made, or if the required number of candidates fail to fill the required number of posts, the unfilled posts will be filled by open competition of the same year. Candidates will be selected by including the posts to be filled by advertisement.
(3) According to this regulation, women soldiers of general service will be engaged in combat related duties only.
