: (1) If it is found that the chairman or any member has lack of capacity or bad conduct or is disqualified according to section 6 or if he has not fulfilled his official obligations according to this Act, the Government of Nepal will form an inquiry committee to investigate such matter.
(2) The investigation committee as per sub-section (1) shall investigate the alleged chairman or member and submit a report with its opinion to the Government of Nepal.
(3) The investigation committee under sub-section (1) shall give reasonable opportunity to the accused chairman or member to present his explanation during the investigation under sub-section (2).
(4) If the inquiry committee under subsection (1) recommends the removal of the chairman or member from office, the Government of Nepal shall remove such chairman or member from office.
(5) After the initiation of the investigation in accordance with this section, such chairman or member shall not be entitled to perform his/her duties until such investigation is resolved.
(6) The remuneration and other facilities of the chairman or member of the investigation committee as per sub-section (1) shall be as prescribed by the Government of Nepal.
