(1) A member or an officer who hears an appeal shall not continue in his position in the following cases: (a) if the term of office expires in accordance with this Act, (b) if his resignation from his position is accepted by the Government of Nepal, (c) on the grounds of bad conduct or lack of efficiency. If removed by the government. (2) According to clause (c) of sub-section (1), the Government of Nepal shall give him a reasonable opportunity to clean up before ordering his removal from office.
