Section 2
Definition
: In this Act, unless the subject or context otherwise requires –
(a) "Establishment" means an establishment as per Clause (b) of Section 2 of the Labor Act, 2048.
(b) "Employee" means permanent, temporary, contract, daily wage, pessrate, contract or agricultural labor employed in various industries, trades, business or services in the establishment and outside the establishment and the term includes managers and managers of the establishment. And also refers to other employees and self-employed persons except the employees working as heads of its departments, branches, sub-branches and units.
(B1) "Agricultural worker" means a person who earns a living by making wages in the agricultural sector.
(c) "Manager" means the manager as per Clause (f) of Section 2 of the Labor Act, 2048.
(d) "Tedr union" means the trade union at the establishment level registered in accordance with this act to protect and promote the professional rights and interests of the workers and the word also refers to the trade union association and the trade union federation.
(e) "Establishment-level trade union" means an establishment-level trade union registered under section 3.
(f) "Tedre Union Association" means a Tedre Union Association registered under Section 4.
(g) "Tedre Union Federation" means Tedre Union Federation registered in accordance with Section 5.
(h) "Official trade union" means trade union at the establishment level which has been recognized in accordance with section 11 for collective bargaining with the management to protect the rights and interests of the workers.
(i) "Working Committee" shall mean the Working Committee constituted in accordance with the Trade Union's Constitution.
(j) "Member" means the workers of the respective establishments who are members of trade unions at the establishment level.
(k) "Officer" means the Chairman, Vice Chairman, Secretary General, Secretary and Treasurer of the Working Committee and the term also refers to the members of the Working Committee.
(l) "Registrar" means appointed under section 14Registrar should be understood and the term also refers to the official appointed by the Government of Nepal to exercise the authority of Registrar.
(d) "Registration book" means the registration book established according to section 16 to register the trade union.
(l) "Labour Court" means the Labor Court under the Labor Act, 2048.
(n) "Prescribed" or "as prescribed" shall mean as prescribed or prescribed in the rules made under this Act or in the order issued by the Government of Nepal by publishing a notice in the Nepal Gazette.
