Section 2
Definition
In this Act, unless the subject or context otherwise requires,–
(a) "Agreement" shall mean a written agreement between the parties to settle any dispute arising immediately or which may arise in the future through arbitration regarding any specific legal relationship whether or not there is an agreement. Explanation: For the purpose of this clause, there shall be deemed to be a written agreement between the parties if any of the following documents:-
(1) Any contract or any other separate agreement in connection therewith, including the provision of an arbitrator,
(2) A letter, telex, telegram, telefax or other means of telecommunication of a similar nature exchanged between the parties to submit the dispute to the arbitrator,
(3) If a party submits a claim to submit a dispute to arbitration, the counterclaim is submitted by the party who counters the claim without refusing to submit the dispute to the arbitrator.
(b) “Party” means any party related to the arbitration.
(c) "District Court" shall mean the place of arbitration if the place of arbitration is specified in the contract and the district court having territorial jurisdiction of the place where the dispute has arisen or where the arbitration proceedings and decision have been made or where one of the parties usually resides.
(d) "High Court" shall mean the place of arbitration if the place of arbitration is specified in the contract and the High Court having territorial jurisdiction of the place where the dispute arose or where the arbitration proceedings and decision were taken or where a party usually resides.
(e) "Dispute" means a dispute which can be settled by arbitration in accordance with this Act.
(f) "Counterclaim" means a claim made by the counterclaim against the claimant.
(g) "Counterclaim" means the counterclaim made by the party claiming against the defendant.
(h) "Arbitrator" means an arbitrator appointed to resolve a dispute and the term includes a group of arbitrators.
