In this Act, p>
(a) Constitutional officers” The Chief Justice appointed on the recommendation of the Constitutional Council in accordance with Article 284 of the Constitution of Nepal, means the head or officer of the constitutional body and the term includes the Supreme Court judge and Article 153 of the Constitution of Nepal This Act came into force on 15th June 2065.

(b) “Lack of Functionality” This means that the constitutional officer is unable to fulfill his official duties due to lack of physical or mental capacity.
(c) “Bad Conduct” The term should mean a situation in which a constitutional official does not behave in accordance with his position, and the term also refers to acts that are considered corruption according to prevailing laws.
(d) “Failure to faithfully perform official duties” This means that the constitutional officer does not fulfill his responsibilities with good intentions according to the prevailing law or does not intend to do so.
(e) “Committee of Inquiry” means the inquiry committee constituted as per sub-section (1) of section 4.
