Rule 59
Family-based care organization _permit
(1) For the operation permit of a family-based care organization, an application should be submitted to the Council in accordance with Schedule-1, in the form of CRO_ format, attaching the documents mentioned in the same schedule.
(2) An organization that wants to get permission according to sub-rule (1) must have fulfilled the following qualifications:- (a) registered as a non-profit social organization according to prevailing laws, (b) the purpose of providing family-based care is mentioned in the organization's statutes, (c) )/ The minimum standards and conditions set by the Council regarding family-based care organizations are met, (d) The director of the organization meets the following qualifications:- (1) Nepali citizen, (2) At least twenty-five years of age, (3) Basic level education Achieved, (4) Received at least seven days orientation training in child rights, child protection and child welfare work,
(5) Not found guilty by a court of law on a criminal charge of moral turpitude,
(6) having high moral character,
(7) Having a source of income for his livelihood.
(3) Upon examination of the application received in accordance with sub-rule (1), the Council may grant permission if it deems it appropriate to permit the operation of a family-based care institution.
(4) The council shall make available the certificate of operation of the family-based care organization in the format as per schedule-2 to the organization which has received permission according to sub-rule (3).
(5) Organizations licensed to operate family-based care institutions shall renew their licenses within three months of the end of each financial year.
(6) An organization that has received a permit to operate a family-based care organization shall submit an application for renewal in the format as per schedule-3 and attach the documents mentioned in the same schedule. (7) According to sub-rule (6), the Council shall renew the operating permit certificate after examining the application.
(8) A family-based care organization in operation at the time of commencement of this regulation shall obtain permission from the Council within one year of the commencement of this regulation.
(9) The council may make an action plan and conduct monitoring and emergency inspections of family-based care organizations that have been granted operating permission in accordance with this rule.
