Evidence of previous convictions and character

(1) In the case of an accused who has been charged with an offense as per paragraph-7, if such accused has not been found guilty by a military court or other court before, or has not received a departmental punishment, the decision may be taken as evidence. For this purpose, the military court can also take into account the character of the accused and his past activities.
(2) Notice to the accused before trial that the evidence as per sub-section (1) may be proved orally or written in the military court book or other government book or such book and the previously convicted offense or the character of the accused and his past activities may also be taken as evidence. It is not necessary to give.
(3) If the military court deems it appropriate, it may keep a record of any decision regarding the accused in accordance with this Act, even without verifying the information received about the accused, his character and past activities.
