Rule 63
Petition for Review

(1) In accordance with sub-section (2) of section 11 of the Administration of Justice Act, 2073, the party who wishes to apply for review of the court's judgment shall attach a copy of the relevant judgment and the necessary documentary evidence in the form of Schedule-5 in accordance with clause (a) of that sub-section. And if it is according to Clause (b), the application should be submitted to the concerned officer in the format of Schedule-6 along with the receipts as per Schedule-3.
(2) When making an application according to sub-rule (1), in addition to what is mentioned in rule 13, it must be disclosed which of the conditions (a) and (b) of sub-section (2) of section 11 of the Administration of Justice Act, 2073 is present, and the fact that the application has been made. .
(3) The petitioner who submits a review application in accordance with sub-rule (1) shall not be kept on the date.
(4) When submitted for hearing on the review petition under sub-rule (1), it shall be submitted before a judge other than the judge who made the first decision.
(5) The petitioner's oral argument and legal practitioner's argument will not be heard unless the relevant bench orders otherwise in the petition for review as per sub-rule (1).
(6) During the hearing on the petition for review, if it appears that the decision should be reviewed according to the request of the petitioner, the bench will order to open the review.
(7) If there is an order according to sub-rule (6), the concerned officer shall issue a notice to the petitioner to appear in the court mentioning that time.
(8) After the petitioner appears in the notice issued in accordance with sub-rule (7), the court shall order him to file the required court fee, appeal fee as per the law for reviewing the case, appeal fee and to issue the notice in the name of the respondent at the rate of ten rupees per person.
(9) If the petitioner files the court fee and fees as per sub-rule (8), the petition for review will be registered as an appeal. When registering in such a way, a separate reference number should be given so that it is recognized that the appeal has been registered from the Roh of the application to be reviewed.
(10) If permission for review is granted, such petition will be heard by a bench of judges other than the judge who first decided and the judge who granted permission.
