Section 26
Provisions related to appeal

(1) A party who is not satisfied with the decision or order made by the authority while exercising the duties, duties and rights mentioned in this act may appeal to the appeal committee as per sub-section (2).
(2) The Government of Nepal shall establish an appeal committee as follows to process and dispose of the appeals filed under sub-section (1):-
(a) The judge appointed by the Government of Nepal on the recommendation of the Council of Justice from among the sitting judges of the Court of Appeals - Chairman
(b) Two persons appointed by the Government of Nepal to be represented from among the persons with at least fifteen years of work experience in the relevant field with at least a master's degree from a recognized university in infrastructure, engineering, law, economics, management, economic or social development, archaeology, public procurement or social development - Member
(3) The chairman and members of the appeal committee shall have the same privileges as the judge of the appeal court.
(4) If the inquiry committee constituted by the Government of Nepal recommends that the member appointed in accordance with clause (b) of sub-section (2) cannot fulfill his official responsibilities based on his bad conduct or lack of efficiency, the Government of Nepal may remove him from office at any time. But before removing him from the position, he should be given an opportunity to submit an explanation.
(5) The Government of Nepal shall provide the necessary staff to the Appeals Committee.
(6) In accordance with this section, the appeals committee shall exercise the same powers as the appellate court under the prevailing law in processing and disposing of appeals.
(7) The Appeals Committee shall follow the procedures of the Brief Procedures Act, 2028, BAMOZIM, while processing and disposing of appeals in accordance with this section.
(8) The decision or order passed by the Appeals Committee shall be final (9) The term of office of the appeal committee shall be one year from the date of dissolution of the authority. The Appeals Committee shall move the appeals and the related appeals to the Appellate Court having the jurisdiction of the place where the central office of the Missile Authority is located.
