Rule 17
<br> to choose an offer
After receiving the proposal according to Rule 15 or 16, the Ministry should first open the technical proposal and evaluate it based on the following:-
(a) Financial status of the proposer,
(b) technical ability and experience of the offeror,
(c) Efficiency and experience of the proposed manpower (d) Organizational arrangement, implementation process and schedule related to project implementation,
(e) Project engineering, design, engineering (f) Environmental study report of the project and the measures to be taken to minimize the adverse impact on the environment (G) Financial resources related to project implementation and related plans,
(h) Other alternative proposals submitted to make the project more feasible and useful.
(2) While evaluating the technical proposal according to sub-rule (1), the Ministry shall choose the proposal of the proposer who gets at least sixty percent marks. If at least two proposals that get 60 percent marks cannot be selected during the selection process, the Ministry will have to approve the technical proposal of another proposer who gets at least 50 percent marks.
(3) After approving the technical proposal according to sub-rule (2), the Ministry shall inform the proposer that the technical proposal has been approved, and the date, time and place of the financial proposal opening.
(4) If the technical proposal is not approved according to sub-rule (2), the Ministry shall notify the person who submitted the proposal to come and withdraw the financial proposal. If the financial proposal is withdrawn within 30 days of such notification, the ministry will have to give the proposal to the concerned person.
(5) The financial proposal will be evaluated on the following basis:-
(a) Proposed fees to be charged to consumers while implementing the project,
(b) the proposed royalty or other amount to be paid to the Government of Nepal and the time and manner of payment of such amount,
(c) Proposed Term of Agreement.
(6) Evaluation of financial proposals in accordance with sub-rule (5).After making the decision, the Ministry will have to choose the most appropriate proposal.
(7) According to sub-rule (5), if more than one proposal is found suitable while evaluating the financial proposal, the Ministry shall choose the alternative proposal in priority.
(8) According to sub-rule (6) or (7), within seven days after the selection of the proposal, the Ministry shall notify the concerned proposer thereof.
