Section 16
Functions, Duties and Powers of the Authority
In addition to the functions, duties and powers written elsewhere in this Act, the functions, duties and powers of the Authority shall be as follows M-
(a) To make suggestions to the Government of Nepal regarding the policy to be adopted for the establishment, development and operation of the Special Economic Zone,
(b) To prepare, arrange for the establishment, operation and management of the special economic zone and the necessary standards for the development of its infrastructure,
(c) Issuance of licenses and renewal of licenses to industries to be established in special economic zones,
(d) Determining the criteria of lease or restoration amount, fee or fee for land, building, service or facilities to be provided to the industry, but in accordance with sub-section (1) of section 6, the establishment of a special economic zone with the participation of the Government of Nepal and the private sector or by the private sector. , operation and management of the land, building, services or facilities provided to the industry from such special economic zone, the amount of lease or restitution, fees or charges shall be as determined by the company establishing, operating and managing such special economic zone in agreement with the special economic zone.
(e) Recommending to the concerned body for services, facilities or tax exemptions to be availed by the industry under this Act,
(f) Lease of land and buildings etc. required for industry,
(g) Periodically inspect the industries established in the Special Economic Zone and take necessary action if any industry is found to have acted contrary to this Act or the rules made under this Act,
(h) Making arrangements for security in the Special Economic Zone,
(i) Making necessary arrangements for the management of service facilities such as banks, post offices, health posts, entertainment centers in special economic zones,
(j) Allowing the investors within the special economic zone to import goods such as machinery, equipment, spare parts, means of transport, raw materials, packaging materials, etc. on the basis of approval of the investment proposal,
(k) To provide certificates of export, import, approval or origin as required by the industry,
(l) Doing other work necessary for the development and promotion of the special economic zone and the industry in that zone.
