Section 5
Functions, Duties and Powers of the Authority

In addition to the functions, duties and powers written elsewhere in this Act, the functions, duties and powers of the Authority shall be as follows:
(a) Granting, suspending or canceling permits and certificates to operate air services to air service operating organizations licensed in accordance with prevailing laws.
(b) Granting, suspending or canceling the permission and certificate as prescribed for the operation of the aviation training institution licensed in accordance with the prevailing law.
(c) Permit as prescribed to organizations that carry out detailed maintenance (overhaul) including production, repair and testing of aircraft and aircraft parts licensed in accordance with the prevailing law, and grant and renew licenses, ratings and certificates of working capacity to experts working in such organizations as prescribed. To issue, cancel, postpone, return and assign the necessary qualification and conduct examination in relation to rating and certification of such license working capacity.
(d) Issuing, renewing, canceling, suspending, returning licenses, rating and certificates of working capacity as specified to qualified persons related to air service operations and necessary in connection with the rating and certification of such licenses. (e) Licenses, rating and certificates of working capacity issued by member countries of the International Civil Aviation Organization or organizations authorized by such countries and detailed maintenance (overhaul) of Nepali aircraft including aircraft repair and testing. (f) Registration and marking of aircraft as prescribed.
(g) Issuing, renewing and revoking the certificate of airworthiness (Certificate of Airworthiness) of the aircraft as prescribed.
(h) Prescribing the conditions for the use of aircraft for the purpose of flight, carrying passengers, mail and goods from the aircraft and other industrial business related work.
(i) To inspect the aircraft, the place where the aircraft is kept, the arrangements related to the flight of the aircraft and the operation of the aircraft service and the detailed repair and overhaul including the aircraft repair and testing.
(j) Designate the entry of aircraft into Nepal, the departure of aircraft from Nepal, the condition of being allowed to fly over Nepal, the air routes and the landing places of aircraft except for the areas and places prohibited by the Government of Nepal.
(k) Providing fire prevention and life saving services within the airport and airport area and coordinating search and rescue operations.
(l) Conducting ground handling services at the airport.
(D) To carry out visual and mechanical flight (Visual and Instrumentation Flight) and determine the requirements of aeronautical charts, prepare and circulate such maps and exchange weather related information for flight.
(d) The Authority shall maintain and use its own aircraft for technical examination of air transport services and related matters.
(n) Air Traffic Service, Flight Information Service, Alerting Service, Air Traffic Advisory Service, Air Traffic Control Service and providing air way performance services and facilities (air navigation services and facilities), area control services (area control services), access area control services (approach control services) and airport control services (aerodrome control services).
(p) To prescribe the unit of measurement to be used in connection with air communication, to prescribe the signals to be used for the purpose of communication by or on the aircraft and the devices to be used in giving such signals.

(d) Prohibiting and controlling the carriage of dangerous goods and substances by aircraft and determining the quantity.
(d) Granting air flight permits and specifying the work, duties, flight and rest hours of the pilots of the aircraft.
(N) To give suggestions to the Government of Nepal regarding the determination of fares for the transportation of passengers and goods in air transport services.
(c) To use or permit the airport, the airport area and the service facilities available there to be used as prescribed for maximum financial benefit and utilization.
(f) Standards and recommendations (appendices and documents) passed by the Convention on International Civil Aviation (Convention) and approved by the Government of Nepal and made under that Convention and determined by the International Civil Aviation Organization (ICAO) etc. to be implemented as needed.
(b) To insure the buildings, aircraft, devices, equipment, etc. owned by the authority as per the requirement.
(B) To carry out other tasks prescribed by the Government of Nepal.
