Section 4
Functions, duties and powers of the authority

(1) The functions, duties and powers of the authority shall be as follows:-
(a) To determine the damage caused by the earthquake (b) Recommending to Nepal government to designate earthquake affected areas,
(c) determining the priority of reconstruction,
(D) Approving the program including policies, plans, budgets and schedules for reconstruction (e) To approve projects related to reconstruction,
(f) To do reconstruction work (g) If land is to be acquired for the implementation of plans or programs related to reconstruction, integrated settlement and integrated housing development, etc., to acquire land by following the procedures in accordance with this Act or to assign responsibility for such work to any agency or officer,
(h) Identifying suitable places for integrated settlement development, integrated housing development (house pooling), rehabilitation and relocation by making necessary criteria and planning and implementing it, (i) To stop any work done or about to be done by any person for the implementation of a project or program related to reconstruction or integrated settlement development or to order the person concerned to do such work only according to the specified quality, standard or method,
(j) If it is necessary to remove the physical structure of a person for reconstruction, to order the concerned body to remove it by paying compensation according to the prevailing law,
(k) Prepare and implement programs related to education, health, agriculture, industry, employment and manpower development, reconstruction and rehabilitation required for reconstruction and rehabilitation. (l) To provide the necessary budget and other resources to the agency responsible for reconstruction (d) mobilizing non-governmental organizations, the private sector or the community as needed for reconstruction,
(d) According to the need, in cooperation with the government, private or non-government sector, community or foreign organizations in Nepal, select the appropriate method and carry out the reconstruction work.r> (n) To coordinate between various agencies to make the work related to reconstruction effective (i) To develop the capacity of the bodies involved in the work of reconstruction (th) Gathering financial resources for reconstruction and making arrangements for their effective use,
(D) After conducting a technical examination of the damaged or dangerous physical structure or ordering the related person to remove or demolish such physical structure, if the structure is not removed or demolished, then the structure itself will be removed or demolished and the actual expenses incurred during such removal or demolition shall be immediately charged to the government dues from the owner. To issue an order to an agency or an official, but if the owner cannot remove or demolish such a structure by himself due to economic poverty, the authority may instruct an agency or an official to remove or demolish the structure at the government's expense.
(d) Inspecting, inspecting and monitoring according to the requirements of the work and action carried out in accordance with the instructions of the authority. (N) To carry out other works related to reconstruction in the earthquake-affected areas.
(2) Regardless of what is written in the prevailing law, the authority shall carry out the reconstruction work to be completed in accordance with sub-section (1) in an expeditious manner, in order to carry out land acquisition, land registration, land registration, public procurement, forest, ancient monument protection and Arrangements related to environmental impact assessment will be based on the procedures approved by the Government of Nepal.
(3) For the purpose of sub-section (2), the Government of Nepal shall make and implement separate procedures. But the procedure will not be made in a way that contradicts the basic principles of the Public Procurement Act.
(4) In this section, when creating the Bamojim procedure or doing any work, it should be done in such a way that it does not adversely affect the environmental balance, healthy competition, transparency and accountability.
(5) Sub-section (3) The procedure of BAMOZIM shall be published in the Nepal Gazette.
