Rule 43
Special provisions regarding promotion

(1) Soldiers from Assistant Soldier to Assistant Rathi Dajan who have completed three years of service in their current position and are not qualified in the file, if there is a vacancy due to age limit or tenure, the Government of Nepal may promote such soldier to a higher position if it deems it necessary based on his special contribution before/one month before the vacancy.
(2) Sub-rule (1) The special level and post required for the promotion of a soldier who has been promoted to the rank of vice-president shall be deemed to have been created automatically and such level and post shall automatically be abolished after the retirement from such military service.
(3) Regardless of what is written elsewhere in this regulation, displaying bravery in war, internal conflict and peacekeeping operations, winning medals in national and international level sports, undertaking adventurous activities such as mountain climbing, protecting the lives of common people/colleagues and national property by risking their own lives. Chief Subedar and Subedar who have done admirable work to increase the honor, reputation and glory of the nation and the Nepali Army can be promoted to the vacant post of assistant soldier and soldiers of the rank below that can be promoted to the vacant post one rank and level higher on the recommendation of the promotion committee. However, according to this rule, the minimum service period of twelve years should be completed when promoted to the rank of Chief Suvedar and Assistant Soldier. The special promotion according to this sub-rule will be done for a person only once during the service period.
(4) Recommendations for promotion in accordance with sub-rules (1) and (3) shall be made on the recommendation of the promotion committee formed for the respective posts. The Government of Nepal will have the right to decide on such promotion to official posts.
