Rule 38
Allocating percent of promotion
(1) When promoted to the rank of assistant soldier, deputy soldier and fellow soldier in the military service subject to rule 7, who has completed the necessary qualifications as per Schedule-6 and obtained an average score of sixty-five percent for the last three years' performance in the official rank in the case of the assistant soldier, and in the case of the deputy soldier and fellow soldier, the average score of the performance in the permanent rank has been obtained at least fifty percent. Promotion will be done based on the recommendation of the committee in the order of seniority among the eligible candidates recommended for promotion.
(2) During the promotion to the rank of soldier under rule 7, the promotion will be done based on the recommendation of the committee in the order of seniority from amongst the eligible candidates who have been serving in the rank of sub-senior or co-senior, who have been serving in the Antashrit Gulm Ba Vyadhi for a minimum of three years and who have fulfilled the qualifications of sub-rule (1).
(3) For the purpose of sub-rule (2), the period of working as a teacher in Nepali Military Bar College, Nepali Military Academy, Junglebarfer and Anti-Biddwih School, Military High School or other similar military schools shall be counted.
(4) For the purpose of promotion from soldier to the rank of chief soldier in the command and staff training group and Ganapati / unit command and staff course group, eighty percent of the vacant positions are promoted from the command and staff training group and twenty percent from the Ganpati, unit command and staff course group based on the recommendation of the promotion committee based on seniority. will be done.
(5) According to sub-rule (4) the number of candidates who have qualified for the respective group in the vacant posts according to the allocated percentage. If there is no candidate, the number of posts will be transferred from one group to another group. (6) Soldier SevFor the purpose of promotion to the rank of Major General, the main soldiers will be divided into Command and Staff Training Group and Ganpati/Unit Command and Staff Training Group and 80% of vacant positions will be selected for Command and Staff Training Group and 20% for Ganpati Unit Command and Staff Training. The command and staff group will be divided into requalification and seniority subgroups. Out of the 80 percent allocated in this way, 10 percent will be divided into merit subgroups and 70 percent will be divided into seniority subgroups. If there are no qualified candidates for the respective groups and subgroups in the vacant positions according to the percentage allocated in this way, the hundred positions will be transferred from the rank order subgroup of the unit command and staff training group to the seniority order subgroup of the command and staff training group. Similarly, senior soldiers of the command and staff training group/unit command and staff training group can be included in the same promotion committee, but if they surpass the senior soldiers who have completed command and staff training, the quota obtained for the unit command and staff training group will automatically be added to the command and staff training group.
(7) Major army officers who are not included in the hundred group according to the number of posts, despite having obtained the necessary elements to be grouped in the subgroup, will be included in the promotion process for the hundred group only if the number of posts specified for the seniority order is vacant. In the number allotted for the merit order subgroup, only the chief fighters who are promoted for the first time will be included and the chief fighters who have been included in the process once will not be included in the second time but the chief fighters who have been promoted in the merit order subgroup will be eligible to be candidates in the seniority subgroup for the second and third time. Eligibility order: If the number of officers who get the required number of members for the sub-group is not reached, the quota will be automatically transferred to the group in order of seniority.
(8) The leading fighters of both the groups will be allowed to be candidates for promotion only up to three times.
(9) Standing in merit order sub-groupIn case of promotion from chief soldiers to the rank of general, the order of promotion will be based on the rank obtained by the chief soldiers in that group. If the number of officers obtained by two or more senior officers in this group is equal, the ranking will be determined based on their seniority within the group. (13) In the case of soldiers, the rank will be determined on the basis of seniority among the cadets who have reached the qualification for promotion and on the basis of achievement within the same cadet. If the number of soldiers of the same cadet rank is insufficient in the vacant quota, the soldiers who have qualified for the junior rank will be included. In this way, if two or more cadets are involved, the total number of cadets will be included, and each cadets will be evaluated separately. : First time participants will be included in the merit order subgroup only and second and third time participants will be included in the lower seniority subgroup only. But officers who have been convicted by a military court for any offense will not be eligible for the sub-group in the order of merit. In the case of Chief Soldiers in the quota allocated for Ganpati and Unit Command and Staff Corps Group, three times the number of vacant positions will be included and evaluated by including three or more than three promoted year Chief Soldiers. (15) On promotion from Assistant Rathi to the higher rank, who have completed the necessary qualifications as per Schedule-6 and have obtained the average performance of General and Assistant Rathi rank of at least seventy percent for promotion - Ninety-five percent of those who have been recommended and have been working in Bahini Command for at least one year and have completed Staff College - have completed Rstaff College, but Five percent of the untrained assistant charioteers as per schedule-6 will be promoted based on the recommendation of the committee in order of seniority.
(16) Completion of training at National Defense College :(NDC) or National Defense University (NDU) or Royal College of Defense Studies (RCDS) or War College or equivalent on promotion from Superintendent to Rathi The promotion will be done based on the recommendation of the committee based on the seniority order among the candidates with high performance evaluation.
(17) Notwithstanding anything contained elsewhere in this regulation, a soldier who has received the training of a corporal at the commencement of this sub-rule shall be eligible for promotion to a higher rank than such rank.
