12A.1 If a person detained under this Act is found to have been detained contrary to this Act or maliciously, notwithstanding anything written in Section 11, such detention order shall be issued within thirty-five days of being detained or released from detention. He can file a complaint in the district court to pay compensation from the local authorities.
12A.2 Subsection 12A. If the complaints filed under 1 are proved, the district court will decide to pay emotional compensation to the complainant from the Government of Nepal, considering the period of detention, the age of the detained person, his social reputation, the financial loss caused to him due to detention, etc.
12A .3 Subsection 12A. The local authority may request the public prosecutor's office to defend the complaint filed under 1, and if such a request is made, the public prosecutor will have to defend him/her in the court.
