Rule 8
Considerations to be taken while interrogating children
: When interrogating children who have been detained on charges of criminal activity, the following should be done by the investigating officer:-
(a) To ascertain whether the 8 children are fit to give statements,
(b) keep his parents, other family members or guardians, child welfare officers or legal practitioners in custody,
(c) To make inquiries in a child-friendly environment where he can answer the questions asked, d) To inquire about the family and social background and other necessary details of the child accused of related criminal acts,
(e) To do it in a language he understands,
(f) Not to interrogate at night, g) Not to interrogate during the day for more than one hour at a time,
(.h) Not to be induced to be in trouble,
(i) Requesting the child court or the local child rights committee to provide the necessary services from registered child psychologists, social workers, if a child psychologist or social worker is needed during the interrogation,
(h) Not to interrogate in public and to arrange a separate room or place for enquiry.
