Section 8
Power to enter, search, seize and arrest without warrant
: (1) If any offense under this Act is being committed in any house, land, vehicle or place and if immediate action is not taken, it is likely that the offender will escape or the evidence of the offense will disappear, the Drug Control Officer or at least A police officer up to the rank of Assistant Inspector of Police can do the following at any time by putting up a leaflet to that effect:
(a) to enter such house, land, vehicle or any other place (b) If there is any obstacle during such entry, to enter the door immediately or to take necessary action to remove such obstacle,
(c) to seize drugs and other goods related to the crime and any document useful for evidence, and
(d) To stop any person suspected of having committed a crime, to conduct a search and, if deemed necessary, to arrest him.
(2) According to sub-section (1), when entering or searching a house, land, vehicle or any other place, a member of the concerned municipality or rural municipality or an official of that place or an employee of any other government office shall be searched. However, even if there is an attempt to prepare a bond in the name of a member of a municipality or rural municipality or a member of the ward committee or in the name of a local official or any other government office employee, if there is a reasonable basis that such persons are not available, a bond may be prepared in the name of at least two drug investigation officers or at least two police assistant inspectors. .
