Section 42
Fugitive Offenses

(1) If any of the following acts are committed, it shall be considered as an offense related to fugitive:-
(a) If he deserts the service after the order of military action has been issued or after such action has commenced,
(b) In case of desertion other than as mentioned in Clause (a),
(c) If any person within the jurisdiction of this Act is knowingly harbored for desertion,
(d) If, knowing that he is a fugitive, acts to provide benefit, help or assistance to him,
(e) If any person within the jurisdiction of this Act has deserted the service or is about to run away but does not give immediate notice to himself or any other superior officer or does not arrest him in accordance with his authority to arrest him,
(f) If the fugitive is not diligently searched and apprehended,
(g) If the necessary action is not taken despite knowing that he is a fugitive,
(h) In case of desertion by leaving the barracks, camp or quarters.
(2) If the person declared missing does not appear or is not found, he will be considered a fugitive.
