Rule 118
Variation Procedure
(1) If circumstances that could not be foreseen at the time of entering into the purchase contract arise during the execution of the contract and the public body has to issue a variation order in accordance with Section 54 of the Act, it shall be issued after completing the process in accordance with this regulation.
(2) According to sub-rule (1), when a variation order for construction work is issued, the following details must be certified by the head of the public body authorized to approve such variation according to Section 54 of the Disclosure Act:
(a) whether or not the drawing, design and specification etc. of the construction work should be changed and if it is changed, the basic nature or area of the construction work will be changed or not,
(b) Technical justification and cause of variation quantities,
(c) Section 5A of the Act. According to sub-section (2) of the percentage of the same if it affects the cost estimate, and
(D) What is included in the approved budget and program or not.
(3) When issuing a variation order for goods or other service work in accordance with sub-rule (1), the following details must be certified by the head of the public body authorized to approve such variation in accordance with Section 54 of the Disclosure Act:
(a) Whether or not the drawing, design and specification etc. of the goods or other services should be changed and if they are to be changed, the basic nature or scope of such goods or services will be changed or not,
(b) Technical proof of variation quantity and cause,
(c) Section a of the Act. According to sub-section (2) of the cost estimate, the percentage thereof,
(D) What is included in the approved budget and program or not.
(4) According to sub-rule (1), when the variation order of consultation service is issued, the following details must be certified by the head of the public body having the authority to approve such variation according to Section 54 of the Disclosure Act:
(a) The scope, requirements, scope conditions, qualification or expertise etc. of the consultancy service should not be changed and if it is changed, the basic nature or field of such service or the proposed skill or specialistSomething that will change or not,
(b) Technical justification and reasons for variation quantities,
(c) Section 5A of the Act. According to sub-section (2) of the percentage of the same if it affects the cost estimate, and
(D) What is included in the approved budget and program or not.
(5) When issuing a variation order in accordance with sub-rule (1), the public body may only issue it on the basis of the recommendations received through a group of experts.
