Section 39
Voting process
(1) The polling officer shall give the ballot paper to the electors present for voting at the polling station in the prescribed manner.
(2) Before handing out the ballot paper to the voters, the polling officer shall give the ballot paper as determined by the Commission after giving the indication as specified in the voter list.
(3) The voter shall cast his vote secretly by affixing the specified seal or mark on the ballot paper.
(4) In the case of the election under the first-past-the-post election system, the voter shall affix the seal or mark as per sub-section (3) in the room with the mark of any one of the candidates chosen by him on the ballot paper and in the case of the election under the proportional election system, in the room with the election mark of any party of his choice. Vote as specified and drop it in the ballot box.
(5) Notwithstanding anything written elsewhere in this Act, in cases where electronic equipment is used for the purpose of voting, the voter shall vote by electronic equipment as prescribed.
