Rule 5
Who can register nomination
- A person who wants to be a candidate in the election and who is qualified according to the constitution and the law can himself or through his representative, proposer or supporter register the nomination paper in the format as per Schedule-1 at the election officer's office on the date and time mentioned in the notification of the election program. (2) In the case of a person who is a candidate on behalf of a party, when registering the nomination paper according to sub-rule (1), the formal letter as per schedule-2 provided by that party should also be filed. The official of the party who has the authority to provide such formal letter shall provide a copy of such formal letter to the Election Officer.
(3) In accordance with sub-rule (1), when registering or having the nomination paper, one person must have proposed and another person must have supported and stamped it. The name of such proposer and supporter must be attached to the nomination paper along with the proof that the name of such proposer and supporter is registered in the voter list as per sub-section (2) of section 17 of the Act.
(4) A person can register a maximum of two nomination papers for the election of the same post with different proposers and supporters.
(5) In the case of chairman, vice chairman, chief, deputy chief, ward chairman and ward members to register the nomination papers according to sub-rule (1) in accordance with section 62 of the Act and women and dalit or minority members of the village executive or city executive and the head, deputy chief or member of the district coordination committee. In case, the bank voucher or cash receipt of depositing the amount as per rule 32 in the bond account specified by the commission should also be submitted.
(6) If the nomination paper submitted as per sub-rule (1) is checked, if it is found to be proper, the election officer shall register such nomination paper and give the copy as per schedule-3 to the person bringing the nomination paper to be registered.
(7) Notwithstanding anything written in sub-rule (6), if an incomplete nomination paper is brought for registration, such nomination paper shall be registered after correcting the incompleteness. If you want to register the nomination paper without changing the behavior that should be corrected, then you have to mention the same behavior in the nomination paper and register the nomination paper.
