Rule 25
Basis of Eligibility of Bidder to Supply Goods
(1) When determining the basis of eligibility of bidders or pre-qualified offerors participating in the procurement process related to the supply of goods, the public body may consider and determine any or all of the following matters as necessary:-
(a) Technical Capability,
(b) Document related to production of goods (manufacturing record),
(c) Technical specification of goods
(d) economic and financial capacity,
(e) Competency of the technician involved in the connection work, if the goods are to be connected (f) guarantee that the goods supplied will operate as specified for a specified period,
(g) Arrangements for maintenance of goods,
(h) availability of service and spare parts,
(i) In the case of the supplier who supplies goods including installation, his skill, thoroughness, experience and reliability.
(2) According to this rule, the public body may request any or all of the following documents according to the nature, quantity, importance or use of the goods when requesting documents to prove the qualification and technical capacity of the bidder or proposer: (a) Nature, quantity, contract amount, date and name and address of such government agency or private organization of the goods supplied by the bidder to the government agency or private organization during the last three years,
(b) If the goods to be procured are of a complex or extraordinary nature, the relevant public body itself or on behalf of such a body, a document that the official body of the country where the bidder or pre-qualified offeror is established has checked its production capacity,
(c) Inspection of the goods to be purchased by the official quality control organization or a recognized body and the certificate given regarding the specification and quality of such goods,
(d) Samples, supplementary details or photographs necessary to prove the authenticity of the goods to be supplied,
(e) Proportion of work related to supply to be done by sub-contractor.
(3) SupplyIf the bidder or the pre-qualified proposer does not innovate or produce the goods to be supplied, the bidder or the pre-qualified proposer must submit a document proving that the manufacturer of such goods has been duly granted the right to submit the proposal for bidding or pre-qualification, to supply and install the goods. will fall.
(4) If a bidder or a pre-qualified offeror who does not operate a business in Nepal receives a purchase agreement, his agent or officer who can fulfill the obligations related to maintaining the goods supplied in accordance with such agreement, providing after-sales service and keeping the necessary spare parts in stock. A document proving that the seller resides in Nepal should be submitted.
