If it is decided to prosecute an accused according to sub-rule (2) or (3) of Rule 7, the Investigation and Prosecution Branch or the Prad Officer designated by that branch shall prepare a charge sheet in the format as per Schedule-2, mentioning the following points and submitting ten evidences and Things or objects related to the offense and in case of detainee, along with the detainee, a case should be filed in the relevant military court:-
(a) Full Name, Surname, Nationality, Computer No., Rank, Unit
of the accused (b) Particulars of offence,
(c) Conduct of statement of accused,
(d) processing of statements of whistleblowers or victims,
(e) the charge against the accused and the evidence thereon,
(f) Related Laws,
(g) Punishment to be meted out to the accused,
(h) The amount of the compensation, if the compensation has to be paid due to the fault (i) If there is a situation where more punishment is required because the accused has already been punished for an offense, the date of the previous punishment and the name of the punishing body,
(j) Other necessary matters related to the case.
