Rule 61
Appeal can be filed through the court deciding the case and the prison
: (1) Notwithstanding anything written in rule 60, the person who wants to appeal can file the appeal through the court deciding the case or if he is in prison.
(2) If the appeal brought for registration according to sub-rule (1) is formal, the relevant court or prison shall complete the procedure of rule 60 and register it.
(3) The appeal registered according to sub-rule (2) shall be sent to the court within seven days by the concerned court or prison. (4) Notwithstanding anything written in sub-rule (3), if there are many plaintiffs or defendants in a case and someone has filed an appeal and it is found that the deadline for appeal has yet to be issued to anyone, the relevant court shall issue an appeal deadline in the name of the remaining persons from the date of receipt of all the documents. (5) After receiving an appeal in the court according to sub-rule (3) or (4), the concerned officer, when examining the appeal paper, finds that the amount or the security deposit required by law has not been received, he shall order the appellant to file the insufficient amount or security deposit.
(6) According to sub-rule (5), if insufficient amount or security deposit is not filed or if the court or prison deciding the case has taken an appeal that cannot be accepted by law, the registrar may return such appeal to the relevant court or prison without registering it.
