(1) The power to prosecute and punish the following offenses under this Act shall be vested in the following authorities or courts:-
(a) Chief District Officer in relation to offenses under sub-sections (1), (2) and (5) of section 9, (b) Director General in relation to offenses under sub-section (2a) of section 9, and (c) Sub-section (3) of section 9 ) and (4) the district court in relation to the offense. (2) No complaint shall be made in relation to any offense punishable under this Act without the permission of the Government of Nepal in relation to gazetted officers and the permission of the Director General in relation to the employees of the Central Statistics Department. (3) Sub-section (1) The decision made by the Chief District Officer or the Director General of BMA shall be appealed to the High Court.
