Section 9
Punishment

(1) If any person who has the duty to give any information or information under section 3 or section 4 or section 5 commits the following offence, he shall be fined Rs. 200.- A fine which may extend to two hundred or imprisonment for a term which may extend to two months or both shall be punished:-

(a) knowingly fails to give or refuses to give such news or information within the prescribed period, or (b) knowingly gives any false news or information provided or procured, but every director-general of such company or organization unless he can prove that he did not know that the offense punishable under this sub-section was committed by any company or organization or that he had made all reasonable efforts to prevent the offense. .Amended by the first amendment.Amended by the second amendment.The manager, secretary or other officer or representative shall be paid Rs. 300.- shall be punished with a fine of up to three hundred or with imprisonment for a term of three months or with both. If he knowingly refuses to produce any document or thing given to be submitted under clause (b) of that section or refuses to answer any question asked under clause (c) of that section or knowingly gives a false answer, he shall be fined Rs. 100.- Fine up to one hundred or imprisonment up to one month or both.

(2a) Section 7 a. In case of collection of data after receiving approval, if data is collected in a way contrary to the prescribed system or conditions when approval is granted, or Section 7B. According to the provisions of this subsection, if any data is to be verified before being used or published, the person or organization that uses it and the person who publishes it without doing so shall be fined up to five thousand rupees for each such offense. Unless it can be proved that the punishment for such offense is the general management of the related organization(3) If the general manager or officer of the department or any authorized officer commits any of the following offences, he shall be fined Rs. 200.- Shall be punished with fine which may extend to two hundred or with imprisonment for a term which may extend to 2 months or with both –

(a) If any news or information or any part thereof is published in contravention of section 8, or

(b) If he fails to comply with or refuses to comply with the order given under this Act or the rules made under this Act or if he does not show due care or diligence in complying with the order, or

(c) negligently or knowingly destroys the data records in his charge. or otherwise injurious to it or wrongly amended by the First Amendment. Addition by the Second Amendment. If any information is made or used in any other way so as to result, or if such record is used for personal gain or unauthorized work. Or if the details are received, he will be charged Rs. 200.- A fine of up to 200 or imprisonment up to 2 months or both will be punished. However, if he publishes the news or details received in such manner, he will be fined Rs. 500.- shall be punished with a fine up to five hundred or imprisonment for a term up to 5 months or both. If he preaches not to answer any question, he will be charged Rs. 500.- Fine up to five hundred or imprisonment up to five months or both.
