After section 92 of the original Act, the following section 92A. Added:- “92a. Provisions related to trade union: (1) Employees can form a trade union subject to this ordinance. (2) Formation of a trade union in accordance with subsection (1). In doing so, the following provisions should be followed regarding the following matters:-
(a) Except for the officer-level employees and doctors who have to work as the head of the office, the employees of the eighth level or below can form a trade union of national-level employees for the benefit of their professional rights and take membership.
(b) The registration of the trade union of the employees shall be in the Department of Labor and Employment Promotion.
(3) The formation of the official trade union shall be as follows:
(a) The employees may form an official trade union with officials chosen by the members of the trade union of employees formed according to sub-section (1).
(b) The official trade union of the employees will be allowed to present their professional demands to the relevant bodies at the district level, departmental level and national level and conduct social dialogue and collective bargaining. In the event that an official trade union of employees is not formed, the trade unions and associations of employees formed according to sub-section (1) shall have the right to conduct collective bargaining by mutual agreement.
(c) Other arrangements related to the official trade union of employees shall be as prescribed.
(4) The work, duties and rights of the trade union shall be as follows:
(a) It shall be the duty of the Trade Union to give creative suggestions and support to the Government of Nepal to make the health service effective and dynamic by protecting and promoting the rights, interests of the employees.
(b) Trade union can conduct creative and creative activities such as meeting, training, training, seminar etc.
