(1) The following persons shall come within the jurisdiction of this Act:-
(a) Persons appointed to the Nepal Army under this Act,
(b) Non-military persons employed by the Nepali Army or in the service of the Nepali Army or going to assist the work of the Nepali Army in a camp or march for the purpose of military action or in an area declared by the Government of Nepal as an area of ​​military action,
(c) Persons selected to be appointed to the Nepali Army.
(2) The person under clause (b) of sub-section (1) shall be deemed to be under the commanding officer of any department, formation or unit attached to him.
(3) In the case that the person referred to in clause (b) of sub-section (1) is not attached to the commanding officer of any department, formation or unit as per sub-section (2), the commanding officer of the force in which he has been serving for some time has been appointed or nominated as his commanding officer. If the officer is not designated or nominated as such, he will be considered to be under the command of the officer commanding the relevant force.
(4) The commanding officer of the force shall not place any of the persons mentioned in clause (b) of sub-section (1) under the authority of an officer inferior to him unless he is a superior officer.
(5) The jurisdiction of this Act shall remain even if the persons referred to in sub-section (1) commit an offense outside the State of Nepal.
(6) Offenses committed by the persons referred to in sub-section (1) against the citizens of the countries where they are engaged in peacekeeping forces of the United Nations shall fall under the jurisdiction of other courts.
