(1) In the event that a passenger ticket is lost or damaged in whole or in part, the compensation to be paid by the Board to the concerned person shall be as follows:-
(a) the price of the passenger bundle on the basis of the declared price for the declared shipment, (b) the price as per clause (a): if not declared, on the basis of the prevailing market price of the place of destination of such passenger bundle, and
(c) According to Clause (b), if the current market price of the destination cannot be disclosed, on the basis of the actual price of such passenger ticket.
(2) While determining the price in accordance with sub-section (1) sub-clause (b) or (c), the type and quality of the passenger group at the time of registration of such passenger group shall also be considered as the basis.
(3) If a passenger bag is lost or damaged and the board has to pay compensation for the same, the compensation mentioned in sub-section (1) shall be provided and the transportation fee and other charges charged for the lost or damaged passenger bag shall also be refunded.
(4) If there is any loss or damage due to the delay in handing over of a passenger ticket, the Board shall pay an amount equal to the loss of such passenger ticket to the concerned person. (5) In case of partial damage to a passenger vehicle and delay in handing over, compensation can be claimed based on the damage or delay in the passenger vehicle.
(6) Except in uncontrollable circumstances. In other cases, if the head of the concerned station fails to hand over the passenger bag within the date mentioned in the passenger bag registration receipt, the relevant person shall be given the amount of fifty rupees per kilogram of passenger bag as compensation for the number of days in handing over the passenger bag. However, if the person who registers/makes the passenger ticket does not come to pay the passenger ticket within the specified date, he/she shall not be required to pay such compensation amount.
