(1) For the purpose of sub-section (1) of Section 9 of the Act, the concerned ministry of the Government of Nepal shall prepare a list of policies, programs or projects that require strategic environmental analysis and submit it to the Government of Nepal, the Council of Ministers.
(2) Before submitting the list as per sub-rule (1) to the Government of Nepal and the Council of Ministers, the concerned Ministry shall obtain the consent of the National Planning Commission regarding such policies, programs or projects.
(3) The list of policies, programs or projects that require strategic environmental analysis obtained according to sub-rule (1) may be approved by the Government of Nepal, the Council of Ministers.
(4) For the purpose of carrying out a strategic "environmental analysis" for the purpose of conducting any policy, program or project under the list as per sub-rule (3), the concerned ministry of the Government of Nepal shall prepare the zoning report and submit it to the ministry for approval.
(5) If it is deemed necessary while studying the zoning report received as per sub-rule (4), the Ministry shall give consent within thirty days from the date of receipt of such report. (6) After obtaining the consent of the ministry according to sub-rule (5), the concerned ministry shall submit the zoning report prepared including the consent to the Government of Nepal, the Council of Ministers for approval.
(7) According to sub-rule (6): If the zoning report submitted is approved by the Government of Nepal, the Council of Ministers, based on that report, the concerned ministry will prepare a strategic environmental assessment report and publish a notice in a national daily newspaper for a period of thirty days to collect opinions and suggestions on it. Should be done and to download such report. It should be made public through the ministry's website.
(8) According to sub-rule (7), if any person or organization suggests any opinion regarding the report, publish the notice within such period.can be sent to the ministry.
(9) Based on the opinions and suggestions received as per sub-rule (8), the concerned ministry shall prepare a strategic environmental analysis report and submit it to the ministry for approval.
(10) If it is deemed necessary while studying the strategic environmental analysis report received according to sub-rule (9), the ministry shall provide the consent within thirty days at the most with the necessary opinions and suggestions. (11) If consent is obtained from the ministry according to sub-rule (10), the concerned ministry shall submit such strategic environmental analysis report to the Government of Nepal, Council of Ministers for approval.
(12) The strategic environmental analysis report submitted in accordance with sub-rule (11) can be approved by the Government of Nepal, the Council of Ministers.
(13) The basis for strategic environmental analysis will be as mentioned in Schedule-15.
