(1) To reduce, eliminate or control pollution and to carry out the work to be done effectively according to the preliminary environmental test or environmental impact assessment report, the Ministry shall appoint environmental inspectors after completing the procedure prescribed by the Public Service Commission or such An employee may be appointed to do the work of an inspector. Qualification of environmental inspectors will be as specified.
(2) The work, duties and rights of the environment inspector shall be as follows:-
(a) To inspect whether pollution abatement, removal or control has been done in accordance with this Act or the rules made under this Act,
(b) To inspect whether noise, heat or waste is emitted from any place contrary to this Act or the rules made under this Act,
(c) To investigate and inspect whether the work has been done in accordance with the conditions specified while giving approval to implement the proposal,
(d) To submit the report of the things observed during the inspection according to clauses (a), (b) and (c) to the designated authority.
(3) In the course of inspecting in accordance with clauses (a), (b) and (c) of sub-section (2), the environment inspector shall, after giving prior notice to the concerned person, organization or proposer, any house, land, building, factory, industry, vehicle, industrial plant , tools, machinery, organisms, objects, records, documents or other goods or objects can be inspected, tested or examined.
(4) The concerned person, organization or proposer shall provide the necessary assistance to the environmental inspector in the course of the inspection according to sub-section (2) or (3). (5) According to sub-section (2) and (3), if any person or organization does not allow the inspection, if any person or organization obstructs the inspection or does not cooperate with the inspection, the environmental inspector may fine such person or organization as follows:
(a) Up to twenty thousand rupees if the inspection is not allowed or if there is opposition in the inspection,
(b) Up to fifteen thousand rupees in case of non-cooperation in inspection.
(6) A person who is not satisfied with the punishment given by the environmental inspector according to sub-section (5) may file a complaint before the designated authority and the decision made by the designated authority in such complaint shall be final.
(7) Other duties, duties and rights of the environment inspector shall be as prescribed.
