(1) The Government of Nepal, in consultation with the provincial government and related local levels, shall designate natural heritage or aesthetic sites, rare wildlife, flora or biologically diverse sites or sites of historical or cultural importance, which are considered very important from the point of view of environmental protection. Nepal will be able to establish environmental protection zones by publishing notices in the Gazette.
(2) During the construction of any road, building, river management, urban planning or any other physical infrastructure, the Government of Nepal, in coordination with the relevant agencies, may determine an area or area and designate a specific area as an open or green area for the purpose of environmental protection.
(3) In accordance with sub-sections (1) and (2), it may be prohibited to carry out any work as specified within the environmental protection area and open or green area.
(4) In case of excessive environmental pollution, landslides, overexploitation of natural resources or natural disasters in a specific area or place, the public health or the environment has been or is likely to be negatively affected, the Government of Nepal shall, in consultation with the relevant local level, designate such area or place as an environmentally sensitive area. may make any appropriate order for balance, management or environmental restoration.
(5) The Government of Nepal may designate places where any harmful or dangerous substances or wastes are stored or disposed of or where there is excessive environmental pollution due to other reasons and prohibit the movement of the general public.
(6) If there is no need to maintain such an area as a sensitive area or a pollution-causing area after improving the environment in accordance with sub-sections (4) and (5), the Government of Nepal may not maintain such a place as a sensitive area or a pollution-causing area.
(7) The local community may be involved in the management of the areas maintained or designated in accordance with this section for environmental protection. Explanation: For the purpose of this section “place"Community" means the community living in or around such an area.
(8) The local community should be made to participate in the benefit obtained from the management of the area managed in accordance with sub-section (7) as prescribed.
