Section 10
Tasks, Duties and Rights of Financial Information Unit

(1) In addition to the duties, duties and rights written elsewhere in this Act, the duties, duties and rights of the Financial Information Unit shall be as follows:- (a) Obtaining details of transactions exceeding or exceeding the limits determined in accordance with this Act, (b) Suspects in accordance with this Act Receiving reports related to transactions, (c) Receiving information regarding currency and bearer exchangeable warrants according to this Act, (d) Receiving other information, documents and details according to this Act, (e) Other reports received according to this Act including suspicious transaction reports and analyze the information, (f) in the course of analysis according to clause (e), if there is any doubt related to money laundering and financial investment in terrorist activities or other offenses, to transmit the results of the analysis to the department or to the agency that investigates the offense according to the prevailing law. (g) Providing training to reporting organizations, related agencies, regulatory agencies and their employees who have the obligation to provide information in accordance with this Act, (h) providing necessary documentation to reporting organizations or related agencies regarding the identification of suspicious transactions, reports and information related to suspicious transactions and To guide, (i) To submit an annual report on their work and actions to the Government of Nepal through the National Bank, including the details of the types of offenses related to money laundering and financial investment in terrorist activities, techniques, methods and trends of offenses, (j) to identify suspicious transactions, In relation to the evaluation, reporting system and its effectiveness, assisting the regulatory body in inspecting the indicator organization as needed or providing support by studying the report of the inspection supervision, (k) establishing mutual cooperation agreements with foreign bodies working of the same nature, and (l) Perform other tasks as specified. (2) The financial information unit provides necessary information or assistance to the agency of any country where it works of a similar nature.(3) When using the assistance and information received by the financial information unit according to sub-section (2), the agency providing such information or assistance shall be able to request information or provide information at the request of a body of a similar nature in any country. The conditions must be followed. (4) When providing information and support to a body working of a similar nature in a country in accordance with sub-section (2), the financial information unit shall also mention the conditions as specified in relation to the use of such information or support. (5) In accordance with sub-section (2) Section 10B also in relation to the information received from the agency of a country that works of a similar nature. (6) While fulfilling the duties, duties and rights of this section, the financial information unit may do the following:- (a) Request and receive necessary additional documents, records, details, information and information from the index organization. , or (b) obtaining access to any commercial data or information, documents or details related to administrative, financial or law enforcement in affiliated bodies, regulatory bodies, public institutions and requesting and receiving such information, documents or details. (7) Suspicious The Financial Information Unit may impose a fine of up to ten lakh rupees on the basis of seriousness to the indicator organization that does not give a report related to the transaction or does not comply with the orders and conditions set according to this Act or does not provide the documents or information ordered to be submitted. (8) The Financial Information Unit may fine the indicator according to subsection (7). While fining the organization, the relevant indicator organization shall be given a reasonable opportunity to present its explanation. (9) The indicator organization that is not satisfied with the fine imposed by the Financial Information Unit according to sub-section (7) may file an appeal before the relevant High Court within thirty-five days. If the organization is fined according to sub-section (7), it must be informed to the regulatory body within seven days.
