Section 10C
Arrangements for withdrawal of foreign exchange, investment and transfer of rights

(1) Foreign investors who have been approved to invest in securities in accordance with prevailing laws shall pay the following amount in foreign currency to Nepal in accordance with the procedure prescribed by the bank by publishing and broadcasting public information. Can be taken out or sent:-
(a) Investments in securities and profits or dividends received thereon,
(b) Investments made as loans or credit facilities and interest thereon.
(2) If a Nepali citizen residing outside Nepal ………… gets permission to invest in foreign exchange within Nepal …………, facilities will be given as per sub-section (1).
(3) In the case of the securities mentioned in clause (a) of sub-section (1), in the case of listed securities, the amount will be at the price as traded in the securities exchange market and in the case of unlisted securities, in the foreign exchange based on the assets of the related institution determined according to the procedure determined by the bank by publishing and broadcasting public information. (4) If the tax or fee to be paid in accordance with the prevailing law is paid in foreign currency, the securities received by a foreign person, firm, company or institution may be transferred to another foreign person, firm, company or institution by the manner of the prevailing law.
(5) As mentioned in the technology transfer agreement made by the foreign investor according to the prevailing law, the money for technical fees, royalties, etc. will be allowed to be taken or sent abroad. Regarding the process of taking or sending repatriation of air tickets and cargo sold in Nepal by its agents or Nepali persons, firms, companies or organizations authorized to do such work, the public notice shall be published and broadcast by the bank as prescribed.
(7) Notwithstanding anything written elsewhere in this section, a person, firm, company or organization that does not earn foreign currency by investing in Nepali currency shall be allowed to receive payment in foreign currency in accordance with this section.
