Rule 13
Number and records of foreign workers
: (1) If there is an agreement between the government of Nepal and such a foreign government or organization to employ foreign nationals in any establishment with foreign investment or foreign assistance, the number specified in the agreement and in the absence of such an agreement, a maximum of three persons. Foreign nationals can be given a labor permit to work in such an establishment by keeping a record.
(2) No employer shall employ foreign workers in excess of five percent of the total number of workers required in his establishment except in cases where he is granted diplomatic immunity or does not have to obtain a labor permit in accordance with any agreement with the Government of Nepal.
(3) In accordance with sub-section (2) of section 23 of the Act, the department shall keep updated records of foreign workers who are not required to obtain a labor permit in accordance with any agreement with the Government of Nepal and who have received a labor permit or labor permit in accordance with rule 8 or rule 9 in the format as per Schedule-5.
(4) Employers who do not need to obtain a labor permit according to section 23 of the Act and who need to obtain a labor permit according to section 24, shall have diplomatic immunity before ordering such workers to keep records in the department in accordance with Schedule 5 of the Act, or shall not be charged according to the agreement with the Government of Nepal, rule 10 The receipt as per sub-rule (1) should be submitted to the department.
(5) If it is found that workers who are required to keep records according to the law are employed without keeping records, the department shall make the employer who employs such workers to pay double the fee charged as per sub-rule (1) of rule 10 and keep the records of such workers.
