Section 6
Jurisdiction and Use of Special Courts
(1) Special cases will be initiated and decided by special courts.
(2) The jurisdiction of the Special Court shall be exercised collectively by all the members of the bench. But a bench with one member can deal with other proceedings of the case except for detention proceedings, and a bench with two members can dispose of proceedings and cases related to detention.
(3) In a bench where three members are present, if the unanimity of all three members or the majority of two members prevails, that vote shall be considered as the decision of the court.
(4) If unanimity is not reached in a bench with two members present, in the case of action, in case of a bench with a chairman, it shall be done according to the opinion of the chairman, and in case of a bench without a chairman, according to the opinion of the senior member, the judgment of the case or the final order shall be submitted to the absent member first and supported by the decision of the court. will be considered.
(5) According to sub-section (4), if the majority cannot be maintained even when presented before the absent member, it shall be presented to the Supreme Court for decision.
(6) The Supreme Court will give priority to the case submitted according to sub-section (5).
(7) The hearing of the case brought under sub-section (5) will be done by the bench of one judge of the Supreme Court and the decision made by that bench will be considered as the decision of the special court.
(8) If more than one bench has to be established in the special court, the chairperson will form the bench and determine the case.
(9) In case the chairman is absent, the authority of the chairman under sub-section (8) shall be exercised by the senior member present.
