(1) The Government of Nepal may, by publishing a notice in the Nepal Gazette, establish a special court with necessary members in consultation with the Council of Justice to process and dispose of special cases in a speedy, efficient and effective manner.
(1A) When a special court is formed according to sub-section (1), if a special court is constituted with more than three members, each bench shall consist of three members.
(2) The President and members of the Special Court constituted as per sub-section (1) shall be appointed by the Government of Nepal in consultation with the Council of Justice from among the judges of the Court of Appeal.
(3) When forming a special court in accordance with sub-section (1), the Government of Nepal shall also specify the territorial jurisdiction and location of such special court.
(4) The Government of Nepal may, by publishing a notice in the Nepal Gazette, designate a place for holding a bench for the period specified in the notice in places other than the place where the special court is located.
