Rule 158
Provisions relating to purchase under special circumstances

(1) When purchasing in accordance with Section 66 of the Procurement Act, the local body shall prepare a written description of the procurement requirements, quality, quantity, condition and period of completion of the work and compete as much as possible for the quantity and time period necessary to face the emergency situation or only one construction contractor, The supplier, consultant or service provider should take a written price or proposal and negotiate for a fair and reasonable price.
(2) If the purchase is made in accordance with sub-rule (1), the following documents should be kept on record:-
(a) Particulars relating to special circumstances,
(b) Failure to immediately purchase would endanger public safety, welfare and community health,
(c) Reasons and grounds for not adopting other methods of procurement.
(3) According to sub-rule (1), if a local body has made a purchase of more than ten lakh rupees, such body shall publish a public notice of the details of such purchase and shall send the same information to the Public Procurement Monitoring Office.
