(1) In the top management of foreign-invested industries, experts, high technicians, managerial staff or technical staff should be recruited from Nepali citizens.
(2) Notwithstanding anything written in sub-section (1), if experts, senior technicians, managerial staff or technical staff cannot be filled by Nepali citizens in the upper management of the industry and technical knowledge or skills have to be transferred through technicians or experts of other countries in such industry, the prevailing law Foreign citizens can be employed according to.
(3) According to sub-section (2), the relevant industry shall provide the department with the details related to the foreign national employed. The department will also provide such information to the Ministry of Finance, Ministry of Home Affairs and Ministry of Labour, Employment and Social Security.
(4) According to sub-section (2), employees and workers employed in foreign-invested industries must comply with the conditions according to the prevailing Nepalese laws.
