Rule 103
Terms of service of salaried legal practitioners
(1) The term of office of a salaried legal practitioner shall be one year and he may be re-appointed if his work is satisfactory.
(2) A salaried legal practitioner shall be relieved of his office in the following cases:-
(a) If his resignation is accepted by the court,
(b) fails to perform the duties in good faith, dishonestly or negligently,
(c) if the court dismisses him for non-compliance with the conduct required of him or for absenting himself from court without notice,
(d) If his term of office expires, (e) If he is punished in any way by the Nepal Lawyers Council, if he dies.
(3) He shall not be deprived of an opportunity to submit an explanation before being relieved of office in accordance with clause (b) of sub-rule (2).
(4) The salaried legal practitioner will get the monthly salary and benefits as determined by the court.
(5) Salaried law practitioners may take a maximum of three days off each month with the approval of the concerned authority except for public holidays. Such leave cannot be accumulated and taken in the next month.
(6) After the salaried legal practitioner is released from his position, he shall compulsorily hand over the files and documents in his charge to the staff designated by the relevant officer of the court.
(7) A salaried legal practitioner is not required to file a separate advocacy when arguing in court.
