(1) A person holding a public office who is required to take an oath according to the prevailing law must take the oath of office and secrecy from the official specified in the constitution or other prevailing laws in the format prescribed in the prevailing law before assuming his duties.
(2) If the constitution or other prevailing laws require taking an oath, if there is a provision but there is no mention of the oath format in such law, the person holding such a public office shall take the oath of office and confidentiality in the format as per the schedule. (3) Appointed, elected or nominated to a public position according to the prevailing law, but there is no provision in the relevant law to take an oath, the person holding such public position shall take the oath of office and secrecy from the official designated by the Government of Nepal.
