Rule 9
Must apply for labor permit
(1) If a foreign citizen wants to work in Nepal, he can submit an application to the department in accordance with Schedule-3 for work permit according to sub-section (1) of section 23 of the Act.
(2) When making an application according to sub-rule (1), the following detailed documents should be attached with the application:-
(a) Attested copy of passport (with at least six months validity),
(b) a certified copy of any certificate of educational qualification, skill or knowledge or competence required for the work concerned,
(c) Letter of acceptance by the employer to employ the applicant (d) Copy of such work agreement letter if work consent of Government of Nepal, Ministry of Home Affairs is required.
(3) Notwithstanding anything written in sub-rule (1), when applying for a work permit, a foreign citizen may apply through the Nepali embassy or diplomatic mission in his country or the Nepali embassy or diplomatic mission in another country that is responsible for seeing that country.
(4) According to sub-rule (1), if any application is received, the concerned embassy or diplomatic mission shall send such application to the department within seven days.
(5) If an application is received according to sub-rule (1) or (3), the department will carry out the necessary investigation on the basis of the detailed documents received with the application. During such investigation, the applicant may be interviewed or skill tested to determine the applicant's qualifications and suitability.
(6) According to sub-rule (1) or (3) labor permit will not be granted if Nepali manpower is sufficient in relation to the work or service for which the applicant has requested labor permit.
(7) If it is deemed necessary to grant a work permit during the examination according to sub-rule (5), the department shall take the application as per sub-rule (1) of rule 10 and grant the labor permit to the applicant in the format as per Schedule...4 within thirty days of the application.
(8) If it is found that the applicant cannot be given a work permit during the investigation according to sub-rule (5), the department shall inform the applicant within seven days.
