Section 263
<br> who can separate their share from the joint property
An owner of a joint property may at any time separate his right or share of the property from the other owner.
(2) According to sub-section (1), joint property should be divided according to the consent of all the owners.
(3) Notwithstanding anything written in sub-section (1) or (2), such property shall not be alienated if the alienation of any joint property causes substantial loss to the other owners or if the nature of the joint property deteriorates.
(4) If any joint property cannot be separated due to the conditions under sub-section (3), the owners of such property should be allowed to divide the proceeds from the sale of such property among themselves based on their right or share.
(5) If the joint property is not sold according to sub-section (4) or if all the owners do not agree to sell and if any owner wants to take such property, such owner can take such property alone by paying the price of such property to the other owner in the same proportion.
(6) According to sub-section (5), if more than one owner wants to take the joint property, the owner who agrees to pay the highest price will be allowed to take such property.
