Rule 77
Special provisions related to the operation of organizations
: (1) For the operation of the organizations mentioned in section 135 of the Act, there will be a board of directors as follows:-
(a) A person elected by the General Assembly - Chairman (b) Joint Secretary, Ministry - Member (c) Joint Secretary, Ministry of Finance - Member (d) Joint Secretary of the concerned Ministry - Member (e) One person appointed by the Government of Nepal - Member (f) Regulations National cooperative development, representative of the board or one chief administrative officer from among the local levels who have purchased the shares of the organization: an official or at least a gazetted official representative of the second class designated by him - member (g) three people including at least one woman elected by the general assembly - member (2) of the organization The chief executive officer shall act as the secretary of the board of directors as per sub-rule (1). (3) The Ministry may conduct necessary studies and approve the restructuring plan in order to arrange the operation of the institutions mentioned in sub-rule (1) in accordance with the cooperative principles, values and beliefs effectively.
(4) Organizations mentioned in Section 135 of the Act, which have not established a committee or an Audit Supervision Committee in accordance with Subsection (1) of Section 48 of the Act, by holding an Annual General Meeting in accordance with Subsection (2) of Section 39 of the Act at the time of commencement of this Regulation, within three months from the date of commencement of this Regulation. The annual general meeting should be held and the election of the committee and the audit supervision committee should be completed.
(5) When purchasing goods or services required by government bodies, if such goods or services have been produced by the organizations listed in Section 135 of the Act, preference shall be given to the goods or services produced by such organizations.
(6) Other arrangements related to the operation of the organizations mentioned in sub-rule (1) shall be as mentioned in the regulations.
