Section 3
Organization formation
: (1) At least thirty Nepali citizens can form a thematic or multi-purpose cooperative organization among themselves.
(2) Notwithstanding anything written in sub-section (1), workers, youth, etc. can form an organization even if there are fifteen Nepali citizens in the case of a cooperative organization that does business based on their labor or skills.
(3) Notwithstanding anything written in sub-section (1), the participation of at least one hundred Nepali citizens shall be required for the establishment of savings and loan trading institutions in the metropolitan and sub-metropolitan areas.
(4) At the time of formation of the organization according to this section, one family should reach the number mentioned in sub-section (1), (2) or (3) at the rate of one member. However, after the organization is registered according to section 15, more than one person from the same family will not be hindered from taking membership of the organization.
(5) Notwithstanding anything else written in this section, at least one hundred employees, teachers or professors who are in positions receiving remuneration from the government of Nepal, the provincial government, the local level or a school, university or an organized institution run by the grant or ownership of such government or level shall agree among themselves. On the basis of their professional association registered in accordance with the prevailing law, they can form an organization by following the conditions and restrictions prescribed in terms of membership, representation and service operation. However, in the same office with less than one hundred people, at least thirty employees, teachers or professors can form an organization by following the terms and conditions specified in membership, representation and service operation.
(2) Notwithstanding anything written in sub-section (1), workers, youth, etc. can form an organization even if there are fifteen Nepali citizens in the case of a cooperative organization that does business based on their labor or skills.
