Section 54
Punishment
(1) If any party commits any of the following acts, the commission may impose a fine up to fifty thousand rupees:-
(a) If he acts contrary to clauses (d), (d), (n), (t) or (th) of section 21,
(b) If the central committee and the state committee are not elected as per sub-section (1) of section 16,
(c) If the organizational structure of the Central Committee and the Provincial Committee is not made on the basis of proportional inclusive representation,
(d) If the audit report is not submitted to the Commission for three consecutive years,
(e) If the financial assistance received in accordance with this Act and the accounting statement of the amount of financial assistance are not submitted within the prescribed period, upon demand by the Commission,
(f) If the order to stop the work of the party is not done according to sub-section (2) of section 11,
(g) If the amount of fine due as per sub-section (4) of section 39 is not filed within the specified period.
(2) If any party commits an act contrary to clause (b), (c), (d), (e), (f) or (g) of sub-section (1), the commission may order such party to correct such act or action within six months. .
(3) If a party does not pay the fine as per sub-section (1) or does not take action within the period as per sub-section (2), the Commission may order such party to be barred from participating in an immediate election.
(4) If a party commits an offense under sub-section (1) more than once or fails to comply with the order given under sub-section (2) within one year or fails to pay the fine, the Commission may cancel the registration of such party in accordance with section 12.
(5) If the party commits any of the following acts, the Commission shall fine as follows:-
(a) If the accounts are not kept as per section 40, if the audit is not conducted as per sub-section (1) of section 41 or if the audit report is not submitted to the commission or if the explanation is not submitted as per sub-section (4), up to twenty thousand rupees,
(b) up to ten thousand rupees if details are not given or inspection is not allowed as per sub-section (4) of section 40,
(c) If the audit report is not made public as per sub-section (5) of section 41, up to seven thousand rupees,
(d) If the details are not submitted as per sub-section (2) of section 42 or the details as per sub-section (2) of section 53If the loan is not published, up to five thousand rupees,
(e) Up to five thousand rupees if the party does not do any other work required to be done by this Act or the rules made under this Act or does not do any work.
(6) The Commission shall fine an amount equal to such assistance to the person or organization who provides voluntary financial assistance in violation of Section 38.
(7) The commission may impose a fine of up to ten thousand rupees on a person who commits the following acts:-
(a) using a protected flag or symbol contrary to section 9 or sub-section (7) of section 10,
(b) If, contrary to sub-section (2) of section 41, the particulars to be mentioned in the audit report are not mentioned,
(c) In case of not submitting property details as per sub-section (1) of section 53.
(8) According to this section, the commission shall give seven days time to the concerned party or person to submit their explanation before punishing them.
